- When the California Department of Social Services makes a negative decision on your case, such as reducing the amount of benefits you receive or terminating them altogether, it will send you a notice informing you of the decision. The notice will include the reasons for the negative decision, the state regulations that support the decision and an explanation of your right to appeal.
- A "timely" notice of action is a notice that is mailed to the recipient within 10 days of the first of the month in which the adverse action is going to take place. Neither the date the notice was mailed nor the first day of the negative action counts is included in the 10-day period, according to the Cash Assistance Program for Immigrants, an assistance program in California that operates notices of action on the same basis as the food stamp program.
- A timely notice of action is waived in qualifying circumstances. These include if the Department of Social Services has learned the recipient has died, the recipient's whereabouts are unknown and the first notice was returned by the post office, the recipient has been admitted into an institution that results in ineligibility for the food stamp program or if the negative action is being taken to prohibit dual benefits (such as when the recipient has applied for assistance elsewhere).
- A few situations exist in which the guardian or representative of a food stamp beneficiary will receive the timely notice of action instead. If the recipient of food stamps is mentally incompetent, the guardian will receive the notice instead. Also, if the recipient has appointed a guardian to take care of paperwork and applications, the notice may be sent to that person instead.
