Prefer Divorce Agreement Over Divorce Trial in Maryland

Maryland has some austere and intricate rules and regulations to be followed if a couple wants to file divorce in Maryland. However, these hectic regulations could be avoided by sidelining the divorce trial procedures and by accepting the divorce agreement with your spouse. Most of the experienced attorneys in Maryland would like to offer you an acceptable agreement on behalf of your spouse. You should accept it or get some alterations done in it, if necessary. It is always better to settle your case out of court through a Divorce Agreement, also called a Separation Agreement or Marital Settlement Agreement.

Accord Factor:

In an agreement, there is scope of accord or harmony which helps in avoiding the bitterness. In trial, lawyers want to prove their point and win the case, so they go for many false blames which generates much more bitterness. However, in a contract, both the parties can include their respective terms and conditions, without blaming each other.

Private affair:

Divorce Agreement is a complete private affaire as opposed to trial which makes everything public. In a contract, couples can sit and resolve their matter amongst themselves. This also helps in maintaining confidentiality.

Detailed documentation:

A Divorce Decree might be a page or two and leave many questions unanswered. But a Divorce Agreement can be as long as you want and cover every detail.

Direct Command and control:

In a Divorce Trial, the Judge who makes the decisions is a stranger to your marriage and you cannot control him or her. However, you can directly control the outcome of Divorce Agreement.

Restrictions:

A Divorce Court Judge has certain limitations in what he or she can order placed in the Divorce Law by the Legislature. You are not restricted by these Laws in an Agreement.

Residency requirement:

Before you can even file a Divorce Complaint, one spouse has to be a resident for a year in Maryland, as per the Maryland Divorce Law. Or, if the grounds for Divorce arose in Maryland then one spouse has to be a resident at the time of filing. There is no residency requirement for a Divorce Agreement.

Grounds:

You need to have Grounds or reasons for a divorce before you file a Divorce Complaint and need to prove it for getting the final settlement. But you can have a Divorce Agreement even if you don't have grounds for Divorce yet.

Legal Separation:

Legal Separation also requires some legal formalities. However, a Divorce Agreement does not require any formality. You can have it even if you are still living together.
Less Expensive:
A Divorce Trial can cost a lot of money to both the spouses. But, you can get a Divorce Agreement for much less cost and with agreement.

Time:
