- The State Department explains a fiancee to be a person engaged or contracted to be married to a U.S. citizen. The fiancee must be legally permitted to be married in the state in which the marriage is to take place.
- The K1 visa is described by the Visa Pro website as usually having a shorter waiting time than other forms of marriage visas. The K1 visa allows the alien fiance to apply for the right to work after arriving in the U.S.
- One of the requirements of the K1 visa is that the couple wishing to be married must have met during the previous two years. This requirement can be waived if meeting a fiancee contradicts cultural customs.
- Upon entering the U.S. with a K1 visa the marriage between the couple must take place within 90 days of the fiance's entrance. After entering on a K1 visa the fiance cannot leave the U.S. and reenter on the same visa, according to the State Department.
- Certain persons are declared ineligible for the K1 visa through their history, according to the State Department. Reasons for ineligibility include infection with HIV/AIDS, overstaying a previous visa, trafficking drugs and advocating the overthrow of the government.
