- 1). To form an LLC in Virginia, contact the Commonwealth of Virginia State Corporation Commission office at 804-371-9733 or toll-free at 1-866-722-2551 to verify business name availability. You cannot use a business name that is already registered to someone else.
- 2). File an Articles of Organization form with the Commonwealth of Virginia State Corporation Commission. Download this form from the State Corporation Commission website (http://www.scc.virginia.gov/publicforms/322/llc1011.pdf) or contact the Commission office to request a hardcopy.
- 3). List the name of the person or business entity to serve as the registered agent. A registered agent agrees to receive all business documentation from the Commonwealth of Virginia. You cannot name your business as its own registered agent. Registered agents may be affiliated with the business or may be a separate business entity that has permission to conduct business in Virginia.
- 4). Mail your completed Articles of Organization form along with a $100.00 filing fee to the Clerk of the State Corporation Commission. Make checks payable to the State Corporate Commission.
