How to Appeal a Visa

    • 1). Visit the website of USCIS (uscis.gov). Use the search toolbar in the upper right hand corner to find form I-601, Application for Waiver of Grounds of Inadmissibility.

    • 2). Print out the application and the instructional booklet. Fill out the application completely in black ink. Provide an "N/A" for questions that cannot be answered.

    • 3). Gather required documents. These may include certified copies of your passport, birth certificate and proof of visa denial.

    • 4). Gather supporting evidence for your appeal. If you were denied on the grounds of criminal inadmissibility then gather evidence of your rehabilitation including police clearances, proof of treatment received and letters of recommendation from respected members of the community. If you were denied on grounds of a health threat gather medical records, affidavits from doctors and write an explanation of how you are managing your health issue to limit the communicable threat to the U.S.

    • 5). Prove hardship to a United States citizen or permanent resident. You are much more likely to get approval if you can prove that a U.S. business or resident will suffer from your absence. Gather affidavits from a friend, relative or U.S. business owner/operator.

    • 6). Mail the application to the nearest U.S. embassy or consulate with the required payment in the form of a money order. Visit the Department of State's website and search their database to locate an embassy or consulate near you.

    • 7). Await a response from the embassy or consulate. You may be required to attend an interview to determine the validity of your claims. You may be subject to a medical exam and fingerprinting.
