We keep our luggage close and safe while we travel by our own vehicles but when we fly, we rely on Airlines to keep it safe. We pay them for keeping our luggage safe and sound.
It is simply not understandable that how can airlines misplace or lose passengers' luggage after all the systematized processing and money spent on the process. The trauma and trouble one might have to face after landing in to another city or country and not finding their valuables and even non-valuable stuff is unimaginable. With frequent scenarios of missing and misplaced luggage, it is important to stay precautious while travelling through airlines. It is suggested to not keep valuables in the suitcase/ bags without informing the airlines authority about the same.
The incident happened to Poonam Gupta. She along with her relatives was travelling via Kuwait-based Jazeera Airways from Dubai to Delhi. After her arrival at IGI International Airport, she found that her 24 Kg heavy suitcase was missing. Airlines admitted its fault that her luggage was missing. It offered Rs 19,200 to her in addition to a return ticket to Dubai as compensation. Poonam refused it as she had faced a bigger loss.
Against this offer, she reached consumer forum and filed a complaint against Jazeera Airlines for losing her luggage. She demanded the compensation worth the valuables. Opposite party in its defense contented that they offered Rs 19,200 to the complainant along with a return ticket to Dubai, which was rejected by Poonam Gupta.
After hearing, the arguments of both the parties and analyzing the evidences forum established that it was a severe deficiency of service at Airlines part but the worth of valuables cannot be given to complainant, as the value was not pre-declared by the passenger. However, on the basis of applicable rates of USD 20 per kg, as per rules and regulations of travel, the offer made by Jazeera airlines does not provide sufficient compensation for harassment, trauma, anxiety faced by passenger on not getting the suitcase. The airline's offer of Rs 19,200 as compensation did not cover the troubles faced by Poonam Gupta. Non-delivery of luggage is considered as a severe deficiency. Hence court ordered opponent party to pay Rs 50,000 to the complainant, Rs 40,000 for all sufferings and Rs 10,000 towards litigation expenses.
Petition to hold the airline accountable for value of the items of the lost suitcase saying that complainant herself to some extent contributed to the loss by keeping valuables in her baggage without stating their value.
Thus next time when you travel make sure that either you do not keep valuables in the baggage or declare its value in advance to avoid future risk of loss.
