How to Make a Landlord Contract Valid in Court

    • 1). Make sure each party signing the lease is legally competent. They must have no mental deficiency that prevents them from understanding the provisions of the lease.

    • 2). Write the landlord agreement in simple, understandable language and print it in at least an eight point font. The tenants and landlord must be able to read and understand the provisions of the lease.

    • 3). Be detailed in the lease. Include details about pets, who is responsible for repairs, and what happens if the tenant is late on rent or in some other way violates the terms of the lease.

    • 4). Do not include provisions in the lease that are not legal. For example, you cannot limit the renter's number of children. You cannot include statements in the lease restricting the leaser's rights to safe housing, legal defense or to have more than one person in the home.

    • 5). Do not attempt to include provisions in the lease requiring the tenant to accept the apartment "as is" if there are any unsafe characteristics of the property that make it uninhabitable. The lease will not be legally binding in court if you include that provision.

    • 6). Check with your state's housing agency about any laws pertaining to leasing documents in your state. Include the necessary provisions in the lease.
