Failed Surgery

In the majority of cases in the UK, surgery is performed without any problems arising. Unfortunately, however, mistakes can be made and a patient is left in a worse condition than before surgery was undertaken. Such mistakes can lead to pain and suffering for a patient, and may result in long-term complications. Surgery Negligence.

Negligent surgery can cover a range of issues. With over 25 years experience, some of the most common types of claim we have encountered include:-

* Wrong-site surgery (such as amputation of the wrong limb or operating on the wrong organ);

* Internal or external damage (including perforation to an organ, or damage done to tissue, bones or nerves);

* Badly performed incisions, leaving extensive scarring;

* Procedure not being carried out properly (for example, sterilisation that is not effective, or fractures left unfixed);

* Instruments left inside a patient.

There are many more types of surgery negligence, all of which can lead to a series of problems for a patient. In many cases further surgery will be needed, while some will be left with long-term or permanent damage. This is particularly true of wrong-site surgery and damages sustained during surgery, which can have a significant impact on the overall health of a patient. In the most extreme cases, mistakes made during surgery can cause serious illness, disability, or even a fatality.

Along with any physical effects, there is also the possibility of a patient suffering psychological problems. Surgery can be distressing at the best of times, and a patient must put their trust into the medical staff. Thus when a mistake is made during surgery a patient is likely to feel angry and upset. Furthermore, if lasting problems arise due to negligent surgery, then a patient must then face the prospect of a coping with these consequences, causing additional distress.

What Action Can You Take?

If you have suffered as a direct result of surgery negligence, then you may be able to make a medical negligence claim. You should seek expert legal advice, as a solicitor will be able to assess your case and advise you on the appropriate course of action.

The type of claim made will differ depending upon what type of negligence has occurred. If successful, you may be able to claim compensation. This may cover the pain and suffering caused by negligent surgery - including both physical and psychological - as well as any expenses lost (such as the loss of earnings or additional medical care).
